From the trial of Socrates to the post-9/11 military commissions, trials have always been useful instruments of politics. Yet there is still much that we do not understand about them. Why do governments use trials to pursue political objectives, and when? What differentiates political trials from ordinary ones? Contrary to conventional wisdom, not all political trials are show trials or contrive to set up scapegoats. This volume offers a novel account of political trials that is empirically rigorous and theoretically sophisticated, linking state-of-the-art research on telling cases to a broad argument about political trials as a socio-legal phenomenon. All the contributors analyse the logic of the political in the courtroom. From archival research to participant observation, and from linguistic anthropology to game theory, the volume offers a genuinely interdisciplinary set of approaches that substantially advance existing knowledge about what political trials are, how they work, and why they matter.

The eleventh Corruption Assessment Report of the Center for the Study of Democracy is focused on the most potent form of corruption affecting Bulgaria: state capture. The report builds on years of CSD experience in the regular monitoring and assessing of the spread of administrative and political corruption. This is now complemented by an assessment of the mechanisms by which powerful lobbies capture government decision making to the benefit of shady business interests and the detriment of public good. The report finds that these two manifestations – administrative corruption and state capture – are closely linked because they represent different facets of the same phenomenon.

La transition vers la démocratie occupe une place de choix dans l'imaginaire espagnol. Miroir positif de la tragédie représentée par la Guerre civile de 1936-1939, vantée à l'extérieur comme un modèle à suivre, cette transition est devenue en Espagne un mythe fondateur. Réputée pacifique, elle n'aurait pas, ou peu, fait couler le sang. Ce livre souligne pourtant le contraire. À partir de données inédites, il conclut à l'existence d'un cycle de violences qui, loin d'être à mettre sur le seul compte de l'ETA, est imputable à des protestataires de tous bords ainsi qu'aux agents de l'État parfois enclins à la bavure. Cet ouvrage se penche sur les motivations et les pratiques des acteurs ainsi que sur la réforme du système répressif franquiste, entachée par le recours à la torture ou à la « guerre sale » contre un terrorisme croissant. Il décrypte en outre le poids des imaginaires dans une Espagne traumatisée par un passé douloureux que réactive la violence du présent. Ainsi, en replaçant la violence et sa mémoire au cœur de l'analyse, il contribue à renouveler l'interprétation de cette période clef de l'Espagne contemporaine. S. B.

A novel and robust framework for the operational and legal analysis of recovering fugitives abroad, Bringing International Fugitives to Justice addresses how States, working alone, in cooperation, or with third-party intervention, strive to secure the custody of fugitives in order to bring them to justice - for prosecution or punishment purposes - while evaluating the lawfulness of those pursuit efforts. The book introduces redefined terms and new concepts to add precision to the discourse; sets forth comprehensive typologies, including of extradition arrangements and impediments; and provides a mapping to account for the full range of means and methods - extradition, collateral and remedial approaches to extradition, and full-scale and fallback alternatives to extradition -by which international fugitives can be retrieved. The study considers the judicial, diplomatic, and policy consequences of reliance on the more aggressive or controversial alternatives, proffering recommendations that, if adopted, could facilitate the recovery of fugitives while minimizing associated risks.

The German Revolution of 1918-1919 was a transformative moment in modern European history. It was both the end of the German Empire and the First World War, as well as the birth of the Weimar Republic, the short-lived democracy that preceded the establishment of the Nazi dictatorship. This book is a major new study of the extent to which national mentalities, or 'ways of war', are responsible for 'national styles' of insurgency and counterinsurgency. Leading scholars examine the ways of war of particular insurgent movements, and the standard operational procedures of states and occupation forces to suppress them. Through case studies ranging from British, American and French counterinsurgency to the IRA and the Taliban, they show how 'national styles' evolve, influenced by transnational trends, ideas and practices. They examine whether we can identify a tendency to resort to a particular pattern of fighting and, if so, whether this is dictated by constants such as geography and climate, or by the available options, or else whether there exists a particular 'strategic culture' or 'national style'. Their findings show that 'national style' is not eternal but can undergo fundamental transformations.
